Terms of service
Please read the following Terms & Conditions carefully. By placing an order with us you are deemed to have read, understood and accepted these terms and conditions.
1. Definitions
1.1 ‘The Company’ means GolfWanker
1.2 ‘Customer’ means any Company or Individual who uses this website to place an Order with the Company
1.3 ‘Goods’ and ‘Products’ means any items offered for sale by the Company.
2. Contract
2.1 Prior to placing products in the Cart, new Customers will be required to complete a Registration form, and existing customers will be required to Log In. The Company requires this information to fulfil any contractual obligations.
2.2 Once the Customer has completed the checkout procedure, and payment has been made then an Order will be deemed to have been placed. An Order Confirmation will be sent.
2.3 Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.
2.4 If we are unable to accept your order, we will inform you of this in writing and will not charge you for the goods. The Company reserves the right to refuse any Order and will not be obliged to provide a reason for doing so. Any payment made by the Customer will be refunded in full and the Contract deemed to be terminated. The Company shall not be liable for any costs incurred by the Customer as a result of this termination.
2.5 Under the United Kingdom’s ‘Distance Selling Regulations’ the Customer has the right to cancel a Contract for the purchase of any goods within fourteen days of delivery.
2.6 Our website is solely for the promotion of our goods in the UK. Unfortunately, we do not deliver to addresses outside the UK.
2.7 Should the Company be unable to supply any of the goods ordered for any reason, the Customer will be contacted and offered an explanation and the opportunity to cancel the Order. Should the Customer decide to cancel the Order then any payment made will be refunded in full.
3. Price
3.1 The Company’s prices are inclusive of VAT at the current rate
4. Payment
4.1 The Company’s online payment system is administered by PayPal and Stripe with most major Credit and Debit cards being accepted. The Company cannot accept any Orders for which payment has not been received in full.
5. Delivery
5.1 Delivery is by Royal Mail 2nd Class, or Royal Mail Signed For 2nd Class, depending on the size or value of the goods. The cost of which is included in the price of the product.
5.2 Royal Mail aim to deliver 2nd Class mail within two to three working days including Saturdays after posting.
5.3 The Company will aim to dispatch the goods to the Customer within two working days of receipt of Order. If there is a longer delay this will be displayed on the website.
5.4 Deliveries will be made to the address and postcode provided by the Customer and the Company cannot accept liability for a late or failed delivery due to an incorrect address.
5.5 Once the Customers order is despatched, a Despatch Confirmation will be sent. The Company cannot accept liability for either the late delivery, or non-delivery of goods as these are deemed to be wholly beyond the Company’s control.
5.6 The goods will be your responsibility from the time we deliver the product to the address you gave us.
6. Returns
6.1 To end the contract with us, please let us know by doing one of the following:
6.1.1 Email us at orders@golfwanker.co.uk. Please provide your name, home address, details of the order and, where available, your phone number and email address.
6.1.2 Write to us at Needham Market Business Suites, Abacus House, Station Yard, Needham Market, Suffolk IP6 8AS, including details of what you bought, when you ordered or received it and your name and address
6.2 If you end the contract for any reason after goods have been dispatched to you or you have received them, you must return them to us. You must post them back to us at Needham Market Business Suites, Abacus House, Station Yard, Needham Market, Suffolk IP6 8AS. If you are exercising your right to change your mind you must send off the goods within 14 days of telling us you wish to end the contract.
6.3 We will pay the costs of return only:
6.3.1 if the goods are faulty or misdescribed; or
6.3.2 if you are ending the contract because we have told you of an upcoming change to the product or these terms, an error in pricing or description, a delay in delivery due to events outside our control or because you have a legal right to do so as a result of something we have done wrong
6.3.3 In all other circumstances (including where you are exercising your right to change your mind) you must pay the costs of return.
6.4 We will refund you the price you paid for the goods by the method you used for payment. However, we may make deductions from the price, as described below
6.4.1 We may reduce your refund of the price to reflect any reduction in the value of the goods, if this has been caused by you handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.
6.4.2 The maximum refund for delivery costs will be the costs of deliver by the least expensive delivery method we offer.
6.5 We will endeavour to may any refunds due to you as soon as possible and at the latest within 14 days from the day on which we receive the product back from you.
7. Warranty
7.1 The Company warrants that all goods will be free from defects at the time of despatch.
7.2 If the Customer is unhappy with the quality of the goods received then the Company will refund the cost of the goods purchased on the following basis:
7.2.1 That the Customer notifies the Company of any defects within 24 hours of delivery;
7.2.2 That the Company be given a reasonable opportunity to view the products in question (in many cases photographic evidence from the Customer may suffice);
7.2.3 That if the claim is accepted, the Company will only refund the cost of the goods purchased.
7.3 Should the Customers order be damaged in transit, then the Company will refund the cost of the Order in full, on the following basis;
7.3.1 That the Customer notifies the Company of any damage within 24 hours of delivery;
7.3.2 That the Company be given a reasonable opportunity to view the products in question (in many cases photographic evidence from the Customer may suffice);
7.3.3 That the Customer retains both the damaged goods and the packaging (to assist the Company in pursuit of its compensation claim with Royal Mail) until informed by the Company that this is no longer required;
7.3.4 That upon request from the Company, the Customer forwards the damaged goods and packaging onto the Royal Mail (a label will be provided) on behalf of the Company;
7.3.5 The Company will refund the cost of the Order in full once the claim has been accepted by Royal Mail.
7.4 Unless by prior agreement with the Company, goods should not be returned. The Company will accept no liability for any costs incurred by Customer should they decide to return goods purchased of their own volition.
8. Website Content
8.1 Every effort has been made to ensure that the images and information displayed on the Company’s website is accurate.
8.2 The company reserves the right to make changes to the content of this website, including these Terms & Conditions, without prior notice.
8.3 The content of this website is protected by Copyright. No part of this website may be produced in any from without prior permission, in writing, from the Company.
8.4 This website may contain links to external sites, however the Company cannot be held responsible for the content of any website that is linked to the Company’s website.
9. This Agreement
9.1 The Company shall not be held liable for any loss or damage incurred by the Customer as a result of Force Majeure. The Company shall notify the Customer as soon as possible should such an event occur.
9.2 Any dispute between the Company and the Customer resulting from these Terms & Conditions will be subject to the jurisdiction of the courts of England and Wales.
